1. Acceptance of Terms

By accessing and using SOA Concierge (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

SOA Concierge is an AI-powered digital concierge service designed to provide recommendations and information to expats residing in Mallorca. The Service:

Uses artificial intelligence (Claude API) to process your queries and provide recommendations
Provides informational recommendations for service providers (legal, tax, real estate, healthcare, etc.)
Is not a substitute for professional legal, financial, or medical advice
Does not create professional relationships with service providers

3. Disclaimer of Professional Advice

The recommendations and information provided by SOA Concierge are for informational purposes only and should not be construed as professional advice.

We are not lawyers, accountants, or medical professionals. Before making any important decisions regarding legal matters, taxes, healthcare, or significant financial transactions, you should consult with qualified professionals. You are solely responsible for verifying the credentials and qualifications of any service providers recommended by our Service.

4. User Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Subscription and Payment Terms

Our Service offers both Free and Pro subscription plans:

Free Plan: Limited to 10 queries per month at no cost
Pro Plan: Unlimited queries for €4.99 per month, auto-renewing

Payments are processed securely through Stripe. Your Pro subscription auto-renews monthly unless you cancel. You can cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period.

6. Refund Policy

We offer a 7-day money-back guarantee for Pro subscriptions. If you are not satisfied with your Pro upgrade within 7 days of purchase, you may request a full refund by contacting our support team. No refunds are provided after 7 days.

7. Intellectual Property Rights

All content, features, and functionality of the Service (including but not limited to design, logos, text, graphics, and software) are owned by SOA Concierge, its licensors, or other providers of such material. You may not copy, modify, distribute, or transmit any content without our explicit permission.

Your chat messages and conversation history are stored and may be used to improve our AI models and Service quality, in accordance with our Privacy Policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOACONCIERGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you for the Service in the past 12 months, or €50, whichever is greater.

9. Prohibited User Conduct

You agree not to:

Use the Service for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the Service or its systems
Violate any applicable laws or regulations
Transmit malware, viruses, or harmful code
Harass, threaten, or abuse other users

10. Termination of Service

We reserve the right to terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice, if you violate these Terms or any applicable law.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Spain, specifically the Community of the Balearic Islands (Mallorca), without regard to its conflict of law principles.

Any legal action, suit, or proceeding arising under or relating to these Terms shall be brought exclusively in the competent courts of Palma de Mallorca, Spain, and you hereby consent to the personal jurisdiction and venue of such courts.
